Gallo (Ass. Coscioni): “La sentenza della Corte europea dei diritti dell’uomo è una induzione al turismo procreativo”

04 NOV- Filomena Gallo è segretario dell’associazione Luca Coscioni, avvocato che segue questi temi e docente di legislazione e bioetica presso l’Università di Teramo l’abbiamo sentita in quanto esperta di queste materie.

Avvocato Gallo lei ha definito questa sentenza “un’ induzione al turismo procreativo” perchè?
Perchè dice che i cittadini austriaci possono andare in altri Paesi. La Corte sostiene che la legislazione austriaca non vieta di recarsi all’estero per effettuare una fecondazione in vitro. Questo si chiama induzione al turismo procreativo. Per di più emerge una duplice contraddizione in questa sentenza: il principio di uguaglianza riconosciuto dalla Carta europea dei diritti dell’uomo. Vorrei ricordare che la prima sentenza è uscita in piena affermazione degli arti 8 e 14 quelli che parlano di rispetto della vita famigliare e diritto di uguaglianza. In più, sempre nella prima sentenza, dell’aprile del 2010, era chiaramente stabilito che i giudici nelle motivazioni dicevano che lo Stato non ha l’obbligo di legiferare in materia ma qualora lo faccia non deve creare situazioni di discrimine.

La legge austriaca cosa dice?
Che l’eterologa la puoi fare se sei sterile e se sei uomo; se invece sei donna non puoi fare l’eterologa che è consentita solo per le tecniche in vivo e con gamete maschile. Quindi la legge applica un duplice discrimine in base al sesso e alla patologia. I giudici europei, sovvertendo la precedente sentenza, hanno praticamente detto che la legge austriaca va bene per questo divieto parziale di eterologa ma poi devono essere gli Stati membri a regolare al proprio interno, singolarmente, la fattispecie. Questa sentenza fa una differenza tra la donna che adotta un bambino e la donna che fa l’eterologa. Non era compito dei giudici della Grand Chambre intervenire nel merito di una differenziazione del genere sul tipo di diritto alla genitorialità. A questo punto sorge spontaneo chiedersi come vengono eletti questi giudici, su quali competenze e come nella stessa Corte possono coesistere verdetti talmente differenti

Che valore avrà questa sentenza nel nostro ordinamento?
È vincolante per lo Stato nei confronti di cui viene emessa. Quindi per l’Austria. Io e il mio collega Baldini abbiamo assistito una coppia che si era rivolta all’associazione Luca Coscioni e chiedeva di aver accesso alle tecniche eterologhe a seguito dell’incidente di costituzionalità che è stato sollevato dal tribunale di Firenze. La legge 40 è stata inviata davanti alla Corte Costituzionale per il divieto all’eterologa e sono seguite altre due ordinanze una a Catania e una a Milano per procedimenti analoghi e la Corte Costituzionale ha rinviato l’udienza prevista per settembre a data da destinarsi in attesa di questa sentenza che ci si aspettava dalla Corte europea dei diritti dell’uomo.

Su cosa sarà valutata la legge 40?
Sulla incostituzionalità. In quanto la legge 40 viola il principio di uguaglianza quando dice che si può accedere alla fecondazione assistita se si è infertili o sterili e però se sei sterile non puoi ricevere l’applicazione dell’unica tecnica che potrebbe consentirti di farti avere una gravidanza. Insomma la legge 40 ti fa accedere ma non ti da accesso alla tecnica di cui hai bisogno perchè la vieta adottando una discriminazione. Il divieto però entra in contrasto con art 3, l’art 29, l’art 32 e l’art 2 della Costituzione.
